This is part three of a three part series on bullying, and anti-bullying initiatives. In this article, we will look at corporate bullying and the correct actions one should take.

In the past several years, there have been many reports of workplace bullying. Our law firm, LaBovick Law Group, is handling several large bullying personal injury cases, both in the workplace and in the schools. It seems that the cliché “once a bully, always a bully” holds true, and that bullying can transcend from the schoolyard to the workplace.

As adults, we feel as though we must handle these types of problems on our own. We believe that our maturity will be able to withstand the bullying and there is no sense in getting others involved. However, workplace bullying is a Human Resources problem that needs to be brought to the attention of the employer. If the employer is unaware of the bullying problem and it results in some form of injury, there may be no legal recourse against the employer for the damages that the bullying has caused. Therefore, it is important that the victim notify Human Resources of the bullying when it commences so that a file may be created in addressing the situation.

The victim should notify the appropriate authorities within the corporate infrastructure in writing and keep a copy of the correspondence. If the problem does not cease within Human Resources, the victim should take the matter up the corporate ladder until it is satisfactorily addressed. With the written correspondence, the employer is on notice of the potential problem that may cause the company legal issues down the road. The employer is more likely to respond quickly and in a manner to resolve the conflict to the satisfaction of the victim.

As an adult, if you find yourself being bullied, you should address the problem immediately within the company and seek counseling if you feel it is necessary to overcome any emotional stress that the bullying has caused. As has been reported on several occasions across the country, employees have allowed themselves to be bullied to the point where they have felt helpless and have committed suicide. While these cases are rare, they could have been avoided had the employee addressed these issues directly with the employer in an appropriate form and had sought professional help for the emotional trauma that was caused. In rare instances, the employee may simply have to find employment elsewhere. However, no respectable corporation would allow bullying to take place within the scope of its business and risk an unnecessary lawsuit if it can be avoided by other means.

As our world becomes more complex and information becomes more available, we are all being made aware that old problems such as bullying are still around and will be for years to come. Whether you are a parent or an employee, you can nip the problem in the bud by protecting yourself and the ones you care about in the aforementioned ways.

Mark R. Hanson, Esq. voices concern in Letter to Editor on Insurance Firm payments

In response to a Palm Beach Post article on LaBovick & LaBovick, P.A. filing lawsuits against several insurance companies in Broward County,  Mark R. Hanson, Esq., made the following statement, which the Palm Beach Post published in its Op/Ed section on May 9.

Insurance Firms should Pay Providers as per Law

I feel compelled to comment on the article regarding the LaBovick law firm [published in the Palm Beach Post.

The article was critical of our firm for filing volumes of claims against various insurance companies for their failure to fully pay health care providers. The article failed to mention that before a suit can be filed, the insurance company is given two chances to pay the correct amount.

Only upon their failure to pay the doctors after being requested twice is a suit filed. If the insurance industry wants to stop these lawsuits, they simply have to pay the health care professionals what the law requires. Instead, they choose to nickel-and-dime the health care industry. When they get caught, they shift the blame by calling the lawyers greedy.

The insurance companies’ failure to follow the law is what is driving up insurance premiums, not the attorneys who enforce the law. What would an insurance company do if their customers underpaid their premiums by $3?

Happy Martin Luther King Day

2009 School Year officially starts - Safety Tips for Back to School

Summer for school age children is officially over and the school Year for 2009-2010 is starting around the country. Drivers will see Yellow school buses on the road in full force. Students will be walking and riding their bikes to school. School zones will be in force in the morning and in the afternoon. We encourage all drivers to drive safely and pay extra attention while you are driving on the roads. If we make a conscious effort on the road, we can save lives.

Parents are encouraged to discuss safety tips with their children, to prevent avoidable injuries and accidents. Studies have shown that 2.2 million school age children are injured each year according to the National SAFE KIDS Campaign. Let’s try and prevent accidents and injuries this year with education and training to students and young children.

The American Academy of Pediatrics created a great safety tip checklist for parents of school age children. We have highlighted a few tips for parents and caregivers to school age children. Please feel free to share these helpful and practical tips with others.

BACKPACK SAFETY TIPS
• Always use both shoulder straps. Slinging a backpack over one shoulder can strain muscles.
• Choose a backpack with wide, padded shoulder straps and a padded back.
• Pack light. Organize the backpack to use all of its compartments. Pack heavier items closest to the center of the back. The backpack should never weigh more than 10 to 20 percent of the child’s body weight.

TRAVELING TO AND FROM SCHOOL SAFETY TIPS
Review the basic rules with your children

School Bus safety tips for students
• Do not move around on the bus.
• Wait for the bus to stop before approaching it from the curb.
• Check to see that no other traffic is coming before crossing.
• Make sure to always remain in clear view of the bus driver.
• Children should always board and exit the bus at locations that provide safe access to the bus or to the school building.

Car Safety tips for students
• All passengers should wear a seat belt and/or an age- and size-appropriate car safety seat or booster seat.
• All children under 13 years of age should ride in the rear seat of vehicles. If you must drive more children than can fit in the rear seat (when carpooling, for example), move the front-seat passenger’s seat as far back as possible and have the child ride in a booster seat if the seat belts do not fit properly without it.
• Remember that many crashes occur while novice teen drivers are going to and from school. You should require seat belt use, limit the number of teen passengers, do not allow eating, drinking, cell phone conversations or texting to prevent driver distraction; and limit nighttime driving and driving in inclement weather.

Bike Safety tips for students
• Know the "rules of the road."
• Use appropriate hand signals.
• Respect traffic lights and stop signs
• Ride on the right, in the same direction as auto traffic.
• Wear bright color clothing to increase visibility.
• Always wear a bicycle helmet, no matter how short or long the ride. Research indicates that a helmet can reduce the risk of head injury by up to 85 percent.

Walking to School safety tips for students
• Make sure your child's walk to a school is a safe route..
• Bright colored clothing will make your child more visible to drivers
• Be realistic about your child's pedestrian skills. Carefully consider whether or not your child is ready to walk to school without adult supervision.
• If your child is young or is walking to new school, walk with them the first week to make sure they know the route and can do it safely.
• Plan a walking route to school or the bus stop. Choose the most direct way with the fewest street crossings
• In neighborhoods with higher levels of traffic, consider starting a “walking school bus,” in which an adult accompanies a group of neighborhood children walking to school.

Survival Teen Driving Program - comes to Palm Beach International Speedway

Are you a parent or a grandparent with a teen at least 16 years of age?

Did you know that:

 Last year, over 5,000 teenagers died in motor vehicle crashes, the leading killer of American youths aged 16 to 19, accounting for more than 40 percent of fatalities in that age bracket.

In an effort to promote road safety, Street Survival Inc and BMW CCA Foundation have teamed up to offer Drivers Education Safety programs across America.

Locally in Palm Beach County, the Everglades Chapter of BMW Car Club is hosting a Tire Rack Street Survival Teen Driving Program at Palm Beach International Raceway on Saturday Aug 8, 2009 from 7am - 4pm.

The program is open to all makes and models of cars. One does not need to own a BMW to participate. Students that register for the program will drive what they bring. All makes are accepted, from minivans and pick-ups to hopped-up sports cars and everything in between.

The program needs 25 students registered by this Friday – July 24 to offer the program for the reduced rate of $60.

The one day course is open to all ages 16 years old (must be 16 years of age on Aug 8, 2009).
If you have learners permit – you must have it for 6 months.
The program will cover learning car control; breaking and use of a wet slippery surface to learn driving skills that will save your life! 

The cost is $60.00 per student. All the monies go to the Street Survival Teen Program sponsored by the BMW CCA Foundation and the SCCA Foundation.
All of our instructors and staff are volunteers.

LaBovick & LaBovick will interview Congressman Bruce Braley in new Podcast series "From the Courtroom".

Congressman Braley (D) Iowa has been fighting for the rights of people for many years.  He is an experienced Trial Lawyer, with twenty three years of practicing law under his belt. He is a past President of the Iowa Trial Lawyers Association and former President of the the Iowa Chapter of the American Board of Trial Advocates. Prior to being elected to Congress, Mr. Braley, served on the Boards of the Association of Trial Lawyers (now known as AAJ) and Iowa Legal Aid.  He was Board Certified in Civil trial Advocacy by the National Board of Trial Advocacy.  In addition, to his legal expertise, he started a scholarship fund for injured workers and their families.

Congressman Braley has been busy in Congress since being elected to represent Iowa's First District in November 2006. He currently serves on the House committee on Energy and Commerce.  Mr. Braley is Vice Chair of the Oversight and Investigations Subcommittee and serves on the Health and the Commerce, Trade and Consumer Protection subcommittees.

Congressman Braley introduced, H.R. 985, Whistleblower Protection Enforcement Act of 2007 to the Floor and has been very instrumental in fighting for Whistleblower protections.

Pittsburgh Steelers - Last minute drive gives them sixth Super Bowl Win

Yesterday's Superbowl XLIII 20in Tampa Florida  was outstanding.  Two teams both with new head coaches and exceptional players stood to make history last night. One for the most Superbowl wins and one for the first Superbowl win of his Franchise. Unfortunately, only one could take home the trophy and that would be the Pittsburgh Steelers. With so many outstanding plays in the game, it is hard to deny that both teams played to win.  There was the magnificent interception by Pittsburgh Steeler linebacker, James Harrison, that ran the ball 100 yards for a touchdown. My heart stopped and I knew that the Steelers wanted to win this game. However, the Cardinals seemed to breathe life into their game scored two touchdowns in the fourth quarter.  Larry Fitzgerald came through for the Cardinals and it really seemed that they were poised to win this Superbowl.

As they say, "It is not over until it is over". With less than 40 seconds on the clock, Sanantonio Holmes decided to leap into the air and come through for his team.  He connected with his Quarterback, Ben Roethlisberger  and scored a touchdown despite being surrounded by Cardinals player trying to block him.  He caught the ball in mid air and held on to it, making the game winning touchdown with only seconds on the clock. 

Although the Cardinals did not win, they played an excellent game. Their players gelled and gave the Steelers several nail biting moments. Their Franchise will no longer be a joke in the NFL and will get attention.  I am sure that we will be seeing more exceptional Football from this team in the coming years.  But for today, we must celebrate the magnificent win of Pittsburgh Coach Tomlin and the Rooney family for believing that this young Coach could give them another Superbowl win. 

Way to Go Steelers!!!!

Holiday Book Drive and Lawyers for Literacy

At LaBovick & LaBovick, we support the community in many ways. Collecting books for young children during the Holiday Season is a part of the firm's 2008 Give Back campaign.

Anyone who wants to participate in this Holiday Book Drive can drop off a book at either our West Palm Beach or Jupiter Office. The book can be wrapped or unwrapped. If it is wrapped, please label the book by indicating if it is for a boy or a girl and by age.

Reading is the foundation of success. Studies have consistently shown that children who are read to and who read themselves do better in schoo and are more likely to graduate. While most kids want video games and things of that nature, reading can provide the foundation for a long successful and healthy life.

Every vote counts - My early voting experience

Yesterday I voted early in Broward County. It was quite an experience. The early voting polls were extended this weekend by Governor Charlie Crist for 12 hours for the weekend. It was strange that Palm Beach County early voting polls were only opened from 10-2 on Sunday, and Broward County early voting polls were opened 10-4pm. Therefore, I left the house at 9:15 am and arrived at the polls at 9:30 am. To my amazement, everyone else was thinking the same thing. The early voting lines were wrapped around two blocks. I grimaced and thought to myself do I come back or do I wait it out with The hundreds of people in line?  I chose the latter and am very happy that I did. It was quite an experience.  I met three wonderful people  (a teacher, an audio engineer and attorney) that helped me pass the time away. I was equally impressed that two were in the 18-29 year old demo. One was a male middle school teacher and one was a female audio engineer. 

I made it very clear to these two outstanding young people how impressed I was with their dedication and commitment to early voting.  Emily, the audio engineer, told me that this was her second polling place that she had visited that morning.  The other poll was at Broward College and was longer than the Pompano Beach public library. She had a family day planned to watch a football game with her family that kicked off at 1pm. Several of us were taking bets on when we would get into the building,  Emily took 12pm, I took 1pm and another woman took 2pm. Unfortunately, I did not win the bet, but then again, none of us won.  However, it did not matter, we all had fun and were making history by standing in the heat, with hundreds of other people waiting in line to cast our vote for our candidate.

Poverty and Blog Action Day

Today is Blog Action Day to help shed light on Poverty around the world.  A lot can be said about the world's poor, but how much is really being done?  In America, we have several working poor.  There are many Americans working that can barely afford food for their families or healthcare, yet they go to work each and every day, but just do not make enough to make ends meet.

What can we do?  We can all lend a helping hand to the less fortunate.  We can support organizations that reach out and help the less fortunate.  We can give money or we can give time.

One critical issue that many working poor families face is healthcare for their children. In Florida, we have a program called Florida KidCare that provides medical insurance for children, birth through age 18.  If a family can't afford to pay the basic premiums, which can be as low as $15/month, a family may qualify for no monthly premiums for their children. 

Another great organization that reaches out and helps the poor and less fortunate is the United Way of  Palm Beach County. This group gives to families and supports many other non profits that help communities. We can all do something to lend a helping hand to the less fortunate.   Education and programming is key to the solution. 

Reach out in your community and find a homeless shelter that welcomes volunteers.  Talk to the residents and listen. Share your story with them and encourage them. If you have no money to give, your time is just as valuable.  If we all do something, our collective efforts can make a difference.

Our legal freedom and the Beijing Olympics 2008

We sometimes forget how fortunate we are to live in an open Society. Journalists covering the Beijing Olympics have been routinely prevented from going into certain parts of Beijing, including Tiananmen Square, have been promised access to the Internet and have not been able to get it. We forget how lucky we are in the United States to have it here, where we can look at things and do what we believe is right and say anything and be critical of Government Officials, Lawyers, Judges and anyone that we want.

As an Attorney, when we are reviewing our files and looking at cases, sometimes we are critical of certain people involved, whether it is the Judge, opposing Counsel, or witnesses. But what we take for granted in our Society is that we can be openly critical, whereas, in a lot of places, we would not have that option. It is special for us to be able to voice our opinions.

In relation to Personal Injury cases, in most Countries, you would not have the right to bring a Suit if you have been hurt. If there is no Healthcare and you do not have the money for it, you would just suffer. When people talk about Tort reform and that there are too many lawsuits, most of those people have not been on the receiving end of an injury. If they ever are, my suspicion is that their opinions would change. It is special in the United States that we have the right to try and balance the scales, when someone has been hurt. The Justice system was never designed for someone to try and make a profit and never have to work again for a relatively minor injury. But it is designed to allow people who have been hurt to get the medical treatment they need to fix the Injury and try to bring them back as close as possible as to where they were before the injury. If they are not able to be brought back physically equal, the Justice system attempts to balance that scale. In addition, the Justice system attempts to provide the injured party the finances that will allow them either to get nursing treatment at home or additional medical care to help alleviate their pain, or wages that they would have earned but can’t because of whatever has happened to them.

Happy Fourth of July - How to Avoid Injuries with Fireworks

Happy Fourth of July!

On Independence Day we reflect and remember the people who paved the way for Americans to have the right to life, liberty and the pursuit of happiness. Let's not forget about the sacrifices that were made for our gift of freedom.

Remember that freedom is a delicate balance. Throughout history, societies have given up their freedom to dictators. Our right to free speech, to assemble and most importantly to vote, is the guarantor of that freedom. Exercise your rights and remember to vote. Don't limit your vote to the presidential election. Vote in all the primary elections. Your community and your country deserve your participation. I have provided a link to several Florida Voters Registration Sites and Florida Supervisor of Elections websites at the end of this blog post.

As you celebrate today, we encourage you to be safe. According to reports, there were nearly, 10,000 injuries in 2007 related to fireworks. In Florida, reports claim 137 fires were started due to fireworks. Injuries and fires that are caused from using fireworks can be prevented, if people are cautious and pay attention to what they are doing. As a parent of three young children, I was surprised to learn that Sparklers have caused more injuries to children under age five than any other type of fireworks. The Consumer Product Safety Commission states that  Sparklers burn at temperatures hot enough to melt some metals. If you are a parent or happen to see children handling Sparklers, make sure they are over the age of 12 and are doing so with Adult Supervision.

If you are purchasing fireworks, be sure that you are buying consumer fireworks from a licensed store or stand. The Consumer Product Safety Commission has safety warnings on legal fireworks packaging. Look for the CPSC label and read the warnings.

Click it or ticket 2008 Florida campaign starts (May 19 - June 1)

The eighth annual Click it or ticket Florida Campaign Kicks off for 2008 today. The campaign runs  from May 19 - June 1, 2008. The Click it or ticket  is a part of a national campaign that encourages drivers to buckle up.

This is a serious issue the LaBovick & LaBovick Law Firm is deeply committed to supporting. This year we partnered with the Dori Slosberg Foundation in helping to make the community more aware of this important roadway safety issue. This year, Governor Crist and law enforcement has  extended the campaign in hopes of saving more lives. Drivers on the roadways should be aware:

During May 19 - June 1, 2008, law enforcement will be increasing normal patrols and enforcement activities. In addition, law enforcement will be practicing a zero tolerance policy for safety belt usage. If a person is stopped for any traffic violation and is caught not wearing a safety belt, he or she will be ticketed. 

Research indicates that when people are wearing their seat belts/safety belts, lives have been saved in automobile accidents and automobile crashes.

Take your child to work day - Palm Beach law firm shares a life lesson with a 10-year old

Today was "Take your Child to Work Day" around the country.  As a boutique Florida Law Firm, I wondered how many children of our staff would come in today.  I was pleasantly surprised when I saw Mark A. Greenberg, an Attorney in our Jupiter Office, bring his son Jared to work today. The main reason is that Attorney Greenberg has a trials coming up and a mediation scheduled for today. Mark, being the caring and loving dad, wanted to have Jared with him today and learn first hand what to experience a Day in the life of a Trial Lawyer, especially one preparing for trial.  Jared often notices his father working late nights in the office and sometimes at home on the computer, writing, going through files and dictating notes for his legal staff of paralegals. 

Jared Greenberg, a 10-year old, saw first hand, how important preparation and following up is for an attorney. He learned how important completing assignments were for schoolwork. Good work takes discipline and hard work. He saw his dad interact with clients and opposing counsel. The art of negotiation and effective listening skills were also on display in today's life lesson in our Jupiter Law Office today. Mark wanted today's visit by Jared to be meaningful, so he assigned him tasks to complete such as making copies, tagging exhibits and other meaningful things that he could work on with the team. I was amazed at how many questions Jared would ask his dad regarding projects he worked on or meetings that he would sit in on. These strong probing questions shows that Jared Greenberg has good instincts.  Who knows? One day when Jared is grown up, he may decide to follow in Attorney Mark A. Greenberg's footsteps to become a Civil Justice Prosecutor and fight for the rights of injured accident victims.

Earth Day - April 22, 2008 - we can all do something

Today, April 22, 2008 is Earth Day. It is amazing that Earth Day has been around since 1970 and I only seem to remember hearing about it a few years ago.  Last week I purchased several reusable shopping bags at Publix, a major chain in the Southeast. Initially, I thought the .99 price tag was just a gimmick to get people to buy a product.  I see that I was wrong, as I bring my 4 bags back to the market with me, I am pleasantly surprised to see other shoppers doing the same.  The bags are awesome. One bag takes the place of 4 plastic shopping bags and two large paper bags. Based on my bagging methods. 

I spoke to Managing Partner, Brian LaBovick, Esq. regarding my post on Earth Day and asked what he was doing today to acknowledge Earth Day. After my story of the Publix "reusable shopping bags" he decided to go out and buy bags for all of our LaBovick & LaBovick staff members in an effort to help promote saving the environment in small steps. Yes, I mention small steps, because if we all take a few steps to make the environment better, it will make a difference. According to the EPA, companies can make a difference at the work place in helping the environment. A few   simple things, to start with include: 1) reducing energy use, 2) Re-use or recycle office products, 3) Use water more efficiently 4) Efficient Commuting for the environment, this includes, working from home when possible, carpooling use of mass transportation 5) Turn off  equipment, copier, printers, computers when not in use, 6) Use energy efficient lighting.

As a Boutique Florida Personal Injury Law firm, we are doing a little bit more than just giving reusable Publix Shopping bags to our employees. About a year ago, Managing Partner, Brian LaBovick, told me that he wanted to go paperless. He asked me to investigate and find the necessary steps on what it will take for us to be a paperless office. Imagine a paperless law firm. Believe it or not, they do exist. They are few and far between, but not impossible.

We are exploring the paperless office, which will take some time and effort, but in the interim, our Florida Injury Law Firm has taken some giant leaps in being more efficient and environmentally friendly. Last year we recycled old computers and monitors, after stripping them of all data, first. We shred and recycle paper and recycle cans that we use for beverages in the firm for staff and clients. We purchased a state of the art copier to scan documents for us to send PDFs of files to Doctors,  Insurance Adjusters, Defense Counsel, Experts and others involved in Personal injury and Qui tam cases we are working on. This cuts down on the use of paper tremendously. We satisfy requests of those that prefer receiving paper instead of a PDF or file.

If our Florida Injury Law firm can take small steps in our business to help the environment, we encourage other firms to join in.  A few weeks ago, the wonderful Governor of Florida, attended a "Going Green" event in Palm Beach County sponsored by Palm Tran. It is nice to see that officials in Florida are trying to make the public aware of their efforts to improve the environment.

You too can make a difference and do your part for our environment.

Highway Saftey Data and Daylight Savings - Turn your clocks ahead this weekend

It's that time of year again.  Daylight Saving Time begins this Sunday at 2 a.m. and ends on November 2. In case you forgot, Daylight Savings is always the second Sunday of March.

In the Fall, we Spring back each year at 2 a.m. on the first Sunday of November. In the month of November, move your clocks back one hour at the resumption of Standard Time.

We uncovered some interesting statistics for Roadway crashes in Florida from the Florida Department of Motor Vehicle Safety Administration. According to published reports, there was a significant spike in crashes in the month of March 2006. There were 24,066 crashes in the month of March, an increase of nearly 3,000 crashes from the month of February.  The number of fatal crashes also increased in March to 308 an increase from February's fatal crashes which were 221. It is important to note that in the month of November, the number of crashes went down from the previous month.  In November 2006 there were 20,984 crashes in Florida, which is much less than the month prior, which was 21,306 total crashes.  Fatal crashes in Florida also went down in November to 240 fatalities, down from 268 fatalities in October. 

We share this information with our readers to hopefully drive home the message for drivers to be safe on the highway, especially in the beginning of Daylight Savings Time, which is the month of March. In 2006, there were 3,097 total fatal accidents in Florida, March had the highest number of fatalities with 308 deaths.
